So what is a Trademark? According to the United States Patent and
Trademark Office (USPTO), a TRADEMARK is either a word, phrase,
symbol or design, or combination of words, phrases, symbols or
designs, which identifies and distinguishes the source of the goods
or services of one party from those of others.
Remember, just registering a Domain is not the same as Trademarking
one. Just because you have a great name doesn't mean it cannot be
taken away from you by someone that already has that name
trademarked.
When you are ready to trademark your name it is recommended that you
hire a patent attorney, because the trademark process can be tricky.
One of the most important processes in applying for a trademark is
searching for potential trademark conflicts. In today's NetDummy, I

UW Chemistry Exam
The following is an actual question given on a University of
Washington chemistry mid-term:
"Is Hell exothermic [gives off heat) or endothermic (absorbs heat)?
Support your answer with a proof."
Most of the students wrote proofs of their beliefs using Boyle's Law
(gas cools off when it expands and heats up when it is compressed) or
some variant. One student, however, wrote the following:
First, we need to know how the mass of Hell is changing in time. So,
we need to know the rate that souls are moving into Hell and the rate
they are leaving. I think that we can safely assume that once a soul
gets to Hell, it will not leave. Therefore, no souls are leaving. As
for how many souls are entering Hell, let's look at the different
religions that exist in the world today. Some of these religions
state that if you are not a member of their religion, you will go to
Hell. Since there are more than one of these religions and since
people do not belong to more than one religion, we can project that
all people and all souls go to Hell. With birth and death rates as
they are, we can expect the number of souls in Hell to increase
exponentially. Now, we look at the rate of change of the volume in
Hell because Boyle's Law states that in order for the temperature
and pressure in Hell to stay the same, the volume of Hell has to
expand as souls are added. This gives two possibilities.
- If Hell is expanding at a slower rate than the rate at which souls
enter Hell, then the temperature and pressure in Hell will increase
until all Hell breaks loose.
- Of course, if Hell is expanding at a rate faster than the increase
of souls in Hell, then the temperature and pressure will drop until
Hell freezes over.
So which is it? If we accept the postulate given to me by Ms. Therese
Banyan during my Freshman year "That it will be a cold night in Hell
before I sleep with you," and take into account the fact that I still
have not succeeded in having sexual relations with her, then (2)
cannot be true, and thus I am sure that Hell is exothermic.
The student got the only A.

The USPTO is the government agency responsible for registering
trademarks and other intellectual properties. This is the first
site to go to if you are interested in trademarking your business
name. You can conduct a free, basic trademark search. You can also
learn very important information about trademarks.

This is a pamphlet that is customarily furnished in response to
general information requests about trademarks received at the Patent
and Trademark Office. A printed copy of this publication is provided
by the USPTO at no charge. It can also be downloaded from this page.
- USPTO Trademark Electronic Application System (TEAS)
This is supposed to make applying quicker and easier. You can also
print the TEAS application form and mail it to the USPTO.
- IBM's Trademark and Patent Website
This is a trademark and patent search website managed by IBM. It has
several features that make your search easier and quicker. You can
narrow the search by patent number, title, or abstract, or by all
claims, assignee, inventors, and attorney/agent.
- Entrepreneur Magazine's Legal Filings
Here, you'll find answers to common questions about the pros and cons
of trademarks, limited liability companies, sole proprietorships, S
corporations and more. Its articles are aimed at the layman and they
are very easy to understand.
