Don't Get Burned: Know Your Legal Rights & Responsibilities
Editor's Note
08.17.00
Today's NetDummy is about internet legal issues. In order to
keep your nose out of trouble, it is very important that you know
what you can, can't, and must do when you post pages on the web. YOU
are solely responsible for the content of your pages.
This newsletter is not intended as a replacement for competent legal
advice. Federal and state laws concerning the internet are changing
constantly, and Laws in one area may be different from those in
another, so if you have questions seek professional advice.
We hope that you find this newsletter interesting and useful.

Copyright Restrictions
Posting other people's graphics, text, or software on a web page can
be a little tricky, but try to use a little common sense and follow
these guidelines:
- Generally, it is permissible to reproduce limited amounts of
copyrighted text. However, copying entire articles without
permission could get you in trouble.
- You might think you can display copyrighted information as long
as you give credit to its owner, but that is a false assumption.
Even if you give proper credit, it is still considered copying.
- If you do include content from another site, make sure your
visitors can distinguish between your work and the work of
others.
- Just because you find things on the Web does not mean you can
safely use them on your site.

Linking and Framing
There have been several law suits to date that concern linking and
framing. Some companies get their panties in a knot if you link to
their pages without taking special steps. For instance, Disney
requires web sites to post a message stating they are not affiliated
with the linking site. Framing is also unpopular with many companies.
If their pages are framed within another site, some of their
advertising may not be seen. There have yet to be any precedent
setting cases on these issues, so be careful.
- Do not frame a linked page within your site's advertising.
- Be careful about using your URL in the address portion of the
browser if the page that is being displayed is from another
site.
- Just to be safe, you could obtain permission from a web site
before framing their pages.
- Avoid giving the impression that the linked or framed site
endorses your site. You might want to post a disclaimer which
states that your site has no affiliation, endorsement, or
sponsorship from the other site.
- Before linking to a page check to see if they have specific
guidelines for linking to their site.
- Don't use logos, slogans, or trademarks for your links.
- Many companies don't like it if you use so called "deep" linking,
wherein you link to a page or content within another site.

Metatags
Metatags are a useful way of getting the right people to your site,
but problems can arise if you use the wrong words.
- Only use metatags that accurately describe the content of your
site.
- Don't use trademarked names or phrases. If you happen to be a
Playboy Playmate, you might be allowed to use those words in
your metatags. However, the issue is still being debated, and
companies like Playboy assert that no one may use their
trademarks.
